Terms of Use

1. Acceptance

By downloading, installing, or using Photonic AI (the “App”) you agree to these Terms of Use. If you do not agree, do not use the App. The App is operated by Shiva Apps LLC.

2. Eligibility

You must be at least 13 years old to use the App, and at least 18 if you reside in a jurisdiction that requires it for using AI-generated imagery services. By using the App you represent that you meet these requirements.

3. Your content

You retain ownership of the photos you upload. By uploading, you grant Shiva Apps LLC a limited license to process those photos solely to train an AI model personal to your account and to generate output images at your request. We do not use your photos to train shared or general-purpose models. You may delete your uploaded photos and trained model at any time from in-app settings.

4. Acceptable use

You agree not to upload photos of anyone without their consent, not to use the App to generate sexual, harassing, defamatory, or deceptive content, and not to attempt to reverse engineer or resell the underlying models. We may suspend accounts that violate these rules.

5. Purchases and subscriptions

The App offers both one-time credit packs (consumables) and auto-renewable subscriptions. Payment is charged to your Apple ID account at confirmation of purchase.

Auto-renewal. Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the period ends. You can manage or cancel in Settings → [Apple ID] → Subscriptions on your device.

Refunds. Refund decisions are made by Apple; we do not process refunds directly. If Apple grants a refund for a credit pack or an unused subscription period, we will revoke the corresponding credits from your balance.

6. AI output disclaimer

The App generates images using AI models. Output may contain inaccuracies or unintended artifacts and is provided on an as-is basis. You are responsible for how you use generated images. Do not represent generated images as unmodified photographs in contexts where doing so is prohibited (for example, identity verification or legal proceedings).

7. Termination

We may suspend or terminate your account if you violate these Terms. On termination we will delete your uploaded photos and trained model within a reasonable period; unused credits are forfeit.

8. Limitation of liability

To the maximum extent permitted by law, Shiva Apps LLC’s aggregate liability for any claim relating to the App is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located there.

10. Changes

We may update these Terms. Material changes will be announced in the App with at least 7 days’ notice before taking effect. Continued use after the effective date constitutes acceptance.
